Terms of Use for the Slot Booking System portal.unikai.de
Scope
(1) These Terms of Use govern the use of the slot booking system portal.unikai.de (hereinafter “Portal”) of
Unikai Lagerei- und Speditionsgesellschaft mbH, Hamburg

20457 Hamburg
(hereinafter “Unikai” or “Operator”),
by registered freight forwarders and their employees (hereinafter “Users”).
(2) By registering and using the Portal, the User accepts these Terms of Use in their current version as binding.
Description of Services
(1) Through the Portal, Unikai provides a web-based platform enabling registered freight forwarders to book delivery and pickup slots for goods at the O’Swaldkai seaport terminal.
(2) Use of the Portal is exclusively online. Access is only possible after activation by Unikai.
(3) Use of the Portal is free of charge.
(4) Unikai reserves the right to modify, expand, or discontinue the Portal in whole or in part at any time. There is no entitlement to uninterrupted or error-free operation.
Registration and Access Data
(1) Registration is required to use the Portal. Complete, accurate, and up-to-date information must be provided during registration.
(2) The User is obliged to keep the access data assigned during registration (username and password) confidential and to protect them against unauthorized access by third parties.
(3) Sharing access data with third parties is prohibited. The User is liable for all activities carried out using their access data, provided they are responsible for the unauthorized use.
(4) Unikai is entitled to block or delete accounts in case of violations of these Terms of Use or misuse of the Portal.
Data Processing and Data Protection
(1) The processing of personal data is carried out exclusively in compliance with applicable data protection laws, in particular the General Data Protection Regulation (GDPR) and the German Federal Data Protection Act (BDSG).
(2) The processing and storage of user and booking data take place exclusively on internal servers of Unikai Lagerei- und Speditionsgesellschaft mbH.
(3) Personal data is only disclosed to third parties insofar as this is necessary for fulfilling the purpose of use or if there is a legal obligation.
(4) Further information on data processing can be found in the Privacy Policy available on the Portal.
User Obligations
(1) The User undertakes to use the Portal solely for its intended purpose — booking delivery and pickup slots.
(2) The User must ensure that all data entered into the Portal (especially booking data) is correct and up to date.
(3) It is prohibited to:

misuse the Portal or circumvent technical security measures,

disrupt the operation of the Portal,

upload content or data that is harmful, unlawful, or inaccurate.
Availability and Liability
(1) Unikai strives to keep the Portal as accessible and trouble-free as possible. However, there is no entitlement to constant availability or specific functionalities.
(2) Unikai accepts no liability for damages arising from temporary unavailability, malfunction, or other technical issues.
(3) Liability for loss of profit, business interruptions, or consequential damages is excluded.
(4) Liability for intentional or grossly negligent conduct, as well as for damages resulting from injury to life, body, or health, remains unaffected.
Copyright and Usage Rights
(1) All content, structures, texts, logos, graphics, and software components of the Portal are protected by copyright and other intellectual property rights held by Unikai Lagerei- und Speditionsgesellschaft mbH.
(2) Use, reproduction, or distribution outside the Portal is not permitted without the Operator’s express written consent.
Changes to the Terms of Use
Unikai reserves the right to amend these Terms of Use at any time. Users will be informed of significant changes in a timely manner. If the User does not object within 14 days of notification, the amended terms are considered accepted.
Term and Termination of Use
(1) The usage agreement is concluded for an indefinite period.
(2) The User may terminate the use of the Portal at any time by giving written notice to Unikai.
(3) Unikai may block or delete access at any time with reasonable notice.
(4) Upon termination, the associated access data will be deleted unless statutory retention obligations require otherwise.
Final Provisions
(1) The law of the Federal Republic of Germany applies.
(2) The place of jurisdiction is Hamburg, insofar as legally permissible.
(3) Should individual provisions of these Terms of Use be wholly or partially invalid, the validity of the remaining provisions shall remain unaffected.
